About this goods categories list

This list should be regarded as a list of goods for the purposes of section 53(6)(c) of the Fair Trading Act 2023.

Aim

This page provides a comprehensive list of the general categories of goods identified by the Office of Fair Trading (OFT). It has been produced to assist applicants for business licences to clearly stipulate what type of trade they intend to carry out. This will in turn assist the OFT to process applications quickly and effectively.

While the OFT considers the list to be extensive, it is not exhaustive. Where you are of the view that a good you intend to trade is not covered by the available categories please set this out in writing to the OFT’s Business Licensing team: business.licensing@oft.gov.gi.

Other requirements

Please note that the sale, importation, exportation and operation of the goods contained in this list may be subject to additional licensing requirements and other restrictions imposed by other enforcement bodies and/or authorities. Applicants should acquaint themselves with the legal requirements surrounding the sale, importation, exportation and operation of any of the goods they intend to trade in.

Business licences and commercial importations

HM Customs will permit the commercial importation by a licence holder of those goods stipulated in their Business licence. The licence holder will first be required to register with HM Customs to do so. Note however that where you, or your business, wishes to import goods for your personal use (and not for trade) you may be able to do so without a business licence. For specific importation, queries please contact HM Customs.

Qualification

The categories and numbering in this list may be subject to change at the sole discretion of the OFT at any time. Such re-numbering or re-categorisation may result in changes to issued business licences.

A.1 All types of meat including porcine, bovine, ovine and equine meats, poultry, game and processed meats; preparations thereof.
 

Restrictions:

  1. Frozen meat except as a constituent of another whole product to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987.
  2. Meat and Meat Products to be imported in accordance with Part III of the Imported Foods Regulations 1998.
A.2 Fish, shellfish and seafood; preparations thereof.
 

Restrictions:

  1. Fresh fish to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987.
A.3 Edible products of animal origins; dairy products, milk, eggs, honey; preparations thereof.
 

Restrictions:

  1. Milk to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987 and under a licence issued pursuant to the Milk Regulations 1988 issued by the Environmental Agency.
  2. Eggs to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987.
A.4 Fruit, vegetables, pulses, mushrooms and similar natural products; preparations thereof.
 

Restrictions:

  1. Potatoes, fresh fruit and fresh vegetables to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987.
A.5 Flour baked food, including bread, patisserie, cakes, biscuits.
 

Restrictions:

  1. Untoasted and leavened brown or white bread, in whole loaves, sliced loaves or rolls except as a constituent of another whole product, bread and roll making dough, whether fresh or frozen to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987.
A.6 Sweets and confectionery, including ice creams, candy and liquorice.
A.7 Cooked and cold food preparations to be consumed off premises, including sandwiches. 
A.8 Seeds, nuts, cereals, miscellaneous grains and leaves, spices and beans; preparations thereof.
A.9 Animal/vegetable cooking fats and oils (excluding CBD products).
A.10 Other edible animal products including snails, insects and frogs; preparations thereof.
A.11 Canned and other packaged food not requiring refrigerated storage.
A.12 Health foods and dietary supplements (excluding CBD products).
A.13 Water
 

Restrictions:

  1. Bottled water or bulk supply water to be imported under a licence issued in accordance with the Public Health Act issued by the Environmental Agency.
A.14 Soft drinks & other non-alcoholic beverages including coffee, tea and fruit juice.
A.15 Intoxicating liquor including wines, spirits and beers.
 

Restrictions:

  1. To be sold only by a holder of a valid licence issued in accordance with the Licensing and Fees Act.
  2. To be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987.
General fashion clothing, including footwear, headgear and related accessories.
B.2 Clothing for children up to the age of twelve years old, not including children’s costumes.
B.3 Non-medical optical equipment, including sunglasses and binoculars.
B.4 Sportswear and sport clothing; parts thereof.
B.5 Security and safety equipment and clothing (not including medical PPE); parts thereof.
B.6 Protective and safety gear for vehicle users; parts thereof.
B.7 Textiles and fabrics, including, silk, cotton, wool, woven fabric, and artificial fur.
B.8 Leather goods and fur-skins.
 

Restriction

  1. The sale, importation and exportation of items referred to in Schedule 3 of the Endangered Species Act 1990 is restricted.
B.9 Haberdashery, sewing materials and accessories related thereto.
C.1 Sports and gymnasium equipment; parts thereof.
C.2 Bags, luggage and travelling goods; parts thereof.
C.3 Musical instruments; parts and accessories.
C.4 Children’s toys and games, including children’s costumes; parts and accessories.
C.5 Umbrellas, sun umbrellas.
C.6 Caravan and camping equipment and accessories (excluding towed or vehicular structures as defined by Schedule 1 Chapter 5 of the Imports and Exports Control Regulations 1987); parts thereof.
 

Restrictions:

  1. The importation of caravans or any other structure devised or adapted for human habitation is prohibited or restricted except under licence issued by the Collector of Customs in accordance with the Imports and Exports Control Regulations, 2003.
D.1 Perfumery, toiletries, cosmetics and other related personal care products.
D.2 Hair products and accessories, including electrical hair products.
D.3 Feminine care products, including sanitary towels, pads, tampons and cups.
D.4 Special purpose beauty products, treatments and accessories; parts thereof .
D.5 Conception kits, contraceptive devices and sexual aids, including condoms, lubricants and sex toys. 
Note:

The OFT shall consider any individual item of jewellery or a watch with a retail value of £5,000 or more to be high value for the purposes of goods categories E1 and E2.

E.1 High value Jewellery made with precious metals and stones; parts thereof.
E.2 High value watches and timepieces; parts thereof.
E.3 Precious metals, stones and gems and including bullion artefacts other than jewellery.
 

Restrictions:

  1. Gold bullion and gold coins to be imported under an import licence issued in accordance with the Imports and Exports (Control) Regulations, 1987).
E.4 Low value jewellery, fashion accessories and other low value wearable items, including costume jewellery, low value watches; parts thereof.
Note:

The OFT shall consider any individual item of artistic work or any antique with a retail value of £5,000 or more to be high value for the purposes of goods categories F2.

F.1 Furniture and household accessories; parts thereof.
F.2 High value art, artistic works (as defined in section 6 of the Intellectual Property (Copyright and Related Rights) Act 2005) and antiques. 
F.3 Low value art and antiques.
F.4 Porcelain, ceramic, glass and glassware.
F.5 Cutlery, flatware, chopsticks and other non-electric kitchen accessories.
F.6 Picture frames, wall murals and related decorative goods.
F.7 Plants, flowers, horticultural goods, gardening accessories, fertilisers.
 

Restriction

  1. The sale, importation and exportation of plants referred to in Schedule 1, Part 2 and Schedule 2 of the Endangered Species Act 1990 is restricted.
F.8 Candles, wax melts, essential oils and other scented products not for personal use and appliances related thereto.
G.1 Household and electro-domestic goods and appliances; parts thereof.
G.2 Audio sound equipment including radios and music systems; parts thereof.
G.3 Televisions, television accessories and mounts; parts thereof.
G.4 Satellite and terrestrial television equipment; parts thereof.
G.5 Climate control appliances and accessories; parts thereof.
G.6 Photographic equipment and accessories; parts thereof.
G.7 Computers, computing related items, parts; hardware & software; parts thereof.
G.8 Mobile telephone, telephones, personal communication devices; parts thereof.
 

Restrictions:

  1. Subject to any licence required for importation under the Communications Act 2006.
H.1 Industrial construction equipment and plant machinery; parts thereof.
H.2 Scaffolding; parts thereof.
H.3 Windows and doors; parts thereof
H.4 Industrial construction materials.
 

Restrictions:

  1. The importation of asbestos materials is prohibited under the Control of Asbestos Regulations 2007.
H.5  Household building materials and equipment; parts thereof.
H.6 Electrical materials and equipment, including cables and lighting; parts thereof.
H.7 Plumbing materials and equipment; parts thereof.
H.8 Flooring material including carpets, tiles, ceramics, laminates and other textile floor coverings.
H.9 Wallpaper, paints and other decorative materials, tools and accessories; parts thereof.
H.10 Tools, construction accessories and general DIY items; parts thereof.
H.11 Energy-conservation materials and accessories; parts thereof.
I.1 Prescription only medicines and drugs covered by the Medicines (Prescription Only) Regulations, 1987 and medicinal products not listed on a general sale list, as per the Medical and Health Act.
 

Restrictions:

  1. To be imported only by a pharmacy registered under the Medical and Health (Registration of Pharmacies) Regulations 2008, a validly registered medical practitioners under the Medical and Health Act or with a licence granted by the Public Health Director under the Medical and Health Act; and
  2. To be sold or supplied only by a pharmacy registered under the Medical and Health (Registration of Pharmacies) Regulations 2008.
I.2 Medical gases in gaseous or liquid form (excluding prescription only medicines and drugs covered by the Medicines (Prescription Only) Regulations, 1987 and medicinal products not listed on a general sale list).
I.3 Any medicinal product specified on a general sale list, as per the Medical and Health Act.
I.4 Optical and audiology equipment, products and accessories for medical use, including testing equipment, lenses, glasses, hearing aids, defenders; parts thereof.
I.5 Medical consumables, including but not limited to gloves, syringes, bandages, cotton wool, sutures, catheters and cannulas. 
I.6 Laboratory supplies, including but not limited to pipettes, blood collecting tubes and microscope supplies.
I.7 Surgical instruments including, but not limited to, scalpels, forceps, lancets, scissors, instrument boxes etc.
I.8 Specialist medical equipment, products and accessories, including but not limited to dental equipment, optometry equipment, diagnostic equipment; parts thereof.
I.9 Personal Protective Equipment for hospital and clinical use (including face masks,  gloves, goggles or other garments or equipment designed to protect the wearer's from injury or infection)
I.10 Devices and equipment for clinical use including resuscitation, rehabilitation, decontamination and patient monitoring equipment; parts thereof.
I.11 Other medical equipment including, stretchers, wheelchairs, rescue equipment, clinical waste equipment; parts thereof.
J.1 Industrial grade appliances and machinery, including commercial kitchen appliances and equipment; parts thereof (to be specified).
J.2 Special purpose appliances and machinery; parts thereof (to be specified).
J.3 Devices and equipment primarily designed to aid the elderly and the disabled, excluding vehicles; parts thereof.
J.4 Office machinery including printers, photocopiers and shredders; part thereof.
J.5 Vending machines, including amusement, gaming, gambling, as defined in the Gambling Act, food and beverage machines; parts thereof.
 

Restrictions:

  1. This goods category does not include the operation of said machines, but the trading thereof.
  2. The operation of gaming machines is regulated under the Gambling Act.
J.6 Industrial cleaning equipment and machinery (not including special purpose vehicles); parts thereof.
J.7 Renewable energy machinery and equipment, including solar panels and turbines; parts thereof.
K.1 Cleaning materials and accessories, including detergents and bleach.
K.2 Other chemical products (to be specified).
K.3 Industrial and special gases in gaseous or liquid form (excluding medical gasses).
K.4 Dangerous substances as defined in the Public Health Act (to be specified).
L.1 Cigarettes
 

Restrictions:

  1. To be sold only by a holder of a valid licence issued in accordance with the Tobacco Act 1997.
  2. To be imported under the authority of an import permit issued by the Collector of Customs issued in accordance with the Tobacco Act 1997.
L.2 Other tobacco products, whether manufactured or not, as defined in the Tobacco Act including cigars and shisha tobacco.
 

Restrictions:

  1. To be sold only by a holder of a valid licence issued in accordance with the Tobacco Act 1997.
  2. To be imported under the authority of an import permit issued by the Collector of Customs issued in accordance with the Tobacco Act 1997.
L.3 Electronic cigarettes, other tobacco substitutes and other nicotine based products (excluding CBD products).
L.4 Smokers’ requisites and paraphernalia.
M.1 Pet food and pet care accessories.
M.2 Medicines and treatments for pets and animals.
Note:

For the purposes of goods categories N, any vehicle with a licensable radio transmitter or wireless control is subject to a licence required for importation under the Communications Act 2006.

N.1 Motor vehicles requiring registration under the Traffic Act including cars, motor cycles and electric vehicles (excluding marine craft) 
N.2 Motor vehicle parts and accessories.
N.3 Marine craft (imported only in accordance with the provisions of the Imports and Exports (Control) Regulations, 1987)
N.4 Marine craft equipment and nautical equipment, parts and accessories.
N.5 Bicycles and electronic bicycles; parts thereof.
N.6 Personal transporters including, scooters, skateboards and self-balancing vehicles (electric or otherwise); parts thereof.
N.7 Other vehicles not requiring motor vehicle registration, including mobility scooters; parts thereof.
N.8 Special purpose motor vehicles, other than those principally designed for the transport of persons or goods.
O.1 Books, and printed materials: newspapers, magazines, stamps.
O.2 Signage, printing materials.
O.3 Stationery and related accessories.
P.1 Digital media, including photography, music and videos;
P.2 Software
P.3 Virtual assets, including those based on blockchain technology e.g. cryptocurrency, non-fungible tokens 
Q.1 Baby and infant products and equipment, including push chairs; parts thereof.
Q.2 CBD products and other products containing hemp for consumption (excluding CBD products).
 

Restrictions:

  1. The Crimes Act 2011 restricts the importation and exportation of a controlled drug (section 503), the production and supply of a controlled drug (section 504), the possession of a controlled drug (section 506) and the cultivation of cannabis (section 508).
  2. Only products that have a Tetrahydrocannabinol (THC) content of less than 0.3% may be traded or imported.
  3. HM Customs may require hemp products to be imported into Gibraltar to be supported by a certificate (or other relevant documentation) from an adequate scientific laboratory (or other relevant organisation) acceptable to HM Customs demonstrating that the product to be imported has a Tetrahydrocannabinol (THC) content of less than 0.3%. 'Hemp products' are defined in the Drugs (Misuse) Regulations 2005 as products which are derived or extracted from a variety of the plant of genus cannabis, including products that contain Cannabidiol (CBD).
Q.3 Petroleum products including oils, lubricants and fuels.
 

Restrictions:

  1. Petrol to be imported under an import licence issued in accordance with the Petroleum Act.
Q.4 Non electric gadgets not covered by another good category, including key rings, button badges, fridge magnets.  
Q.5 Charcoal, lumber and wood.
Q.6 Disposable plastic, cardboard, aluminium and paper products.
Q.7 Funerary products and accessories, including burial caskets.
Q.8 Batteries and accumulators as defined in Part IV of the Environment (Waste) Regulations 2007.
Q.9 Pallets, packaging and other goods used for transport.
Q.10 Temporary structures, including porta cabins.
Q.11 Collectable and commemorative currency, including coins and bank notes, and related items; Not including fiat money in general circulation.
Q.12 Scrap metals and other materials for reprocessing.
 

Restrictions:

  1. The import or export of Waste (Hazardous or non-hazardous) is not allowed except with the consent of the Environmental Agency issued in accordance with the Public Health Act.
Q.13 Pyrotechnical products.
 

Restrictions:

  1. Subject to a licence issued by the Collector of Customs issued in accordance with the Imports and Exports (Control) Regulations, 1987.
  2. Subject to a licence from the Commissioner of Police issued in accordance with the Explosives Regulations.
Q.14 Penknives, sheath knives and other items with blades or that are sharply pointed.
 

Restrictions:

  1. It is an offence to sell, offer for sale or expose for sale a “flick knife” or “flick gun” or a “gravity knife” as defined in section 123(1) of the Crimes Act 2011.
